The Czech Young Legal Theorists (CYLT) invites you to the second round of our discussion series: Jurisprudential Cocktails!
This time: Margaritas + "Textualism's Defining Moment" by Eskridge, Slocum, Tobia (2023)! 🔤📜💥
The authors show how the US Supreme Court's allegedly unified textualist approach might actually undermine the rule of law – textualism's own core goal. The article maps out the key theoretical choices textualists face and what this means for legal interpretation.
We'll explore what textualism really is and how it plays out. We we will also focus on the CEE context, where the debate about textualism is often overlooked or simplified to post-communist heritage.

The Czech Young Legal Theorists (CYLT) warmly announces a first round of our new discussion group: Jurisprudential Cocktails.
We’ll discuss Holger Spamann’s provocative paper:
“Civil v. Common Law: The Emperor Has No Clothes” 👑👔❌
Spamann argues that the classic civil/common law divide is more myth than reality — with few consistent differences and even fewer that matter. Are we clinging to a legal illusion? 🤔⚖️
The event is rather small and private, but we might still have 1-2 places available.

Autumn PhD Workshop in Legal Theory – A Huge Thank You to Our Participants and Discussants!
We are glad to celebrate the success of our first event, which we co-organised, the Autumn PhD Workshop in Legal Theory, held on November 29th at Masaryk University in Brno. Organised by Tomáš Koref and Linda Tvrdíková, the workshop offered a unique platform for PhD students to present their research, receive thoughtful feedback, and engage in vibrant discussions with peers and experts.
The event opened with warm introductory remarks by Martin Škop and an inspiring keynote on academic writing by Michal Bobek.
Throughout the day, presentations and discussions were enriched by the contributions of Zsófia Folková, Michael Preisig, Tomáš Koref, Weronika Dzięgielewska, George Dick, Daniel Barták, Kelly Amal Dhru, Marlene Anzenberger, Václav Lipš, and Marek Švajda. We sincerely appreciate the discussants—Olga Rosenkranzová, Michal Bobek, Preston John Stovall, Terezie Smejkalová, Marek Káčer, Visa Kurki, Lukáš Hlouch, and Marlene Anzenberger—whose feedback and thoughtful insights were invaluable.
A special thank you goes to Martin Hapla for his support and to Masaryk University, Faculty of Law for being such a welcoming host.
